Welcome to MAKA Games. By accessing our website, booking services, or renting equipment from us, you agree to the following Terms & Conditions.

If you do not agree, you must not use our website or services.

1. General Terms

Acceptance of Terms
By using our website or renting from MAKA Games, you agree to be bound by these Terms & Conditions and all applicable laws.

Changes to Terms
We may update these Terms & Conditions at any time. Updates will be posted on this page, and continued use of our services constitutes acceptance of the revised terms.

Relationship Between Agreements
These Terms & Conditions must be read together with our Game Rental Agreement, Terms of Service & Liability Waiver (the “Waiver”).

The Waiver forms an integral part of your agreement with MAKA Games and includes important provisions related to liability, risk, indemnification, and your responsibilities during the rental period.

In the event of any conflict between these Terms & Conditions and the Waiver, the Waiver will prevail with respect to rental, risk, and liability matters.

2. Services Provided

Game Rentals
MAKA Games provides handcrafted game rentals for events, gatherings, and personal use.

Availability
We strive to keep availability accurate, but all bookings are subject to availability and confirmation. We reserve the right to substitute or cancel items if necessary.

3. Bookings & Rental Process

Eligibility
You must be at least 19 years of age and legally capable of entering into a binding agreement.

Rental Agreement & Liability Waiver
By completing checkout, you are required to review and accept our Game Rental Agreement, Terms of Service & Liability Waiver.

This agreement is legally binding and includes:

  • Assumption of risk

  • Release of liability

  • Indemnification obligations

  • Equipment responsibility terms

By booking with MAKA Games, you confirm that you have read, understood, and agreed to the Waiver.

Payment
Full payment (including applicable taxes and fees) is required at the time of booking unless otherwise agreed.

Security Deposit
A security deposit may be required and will be outlined during checkout. The deposit may be used to cover damages, loss, cleaning, late fees, or other charges as described in the Waiver.

4. Use of Equipment

Proper Use
You agree to use all rented equipment safely, responsibly, and in accordance with any instructions provided.

Responsibility
You are fully responsible for the equipment during the rental period, including its use by any third party.

Damage or Loss
You are responsible for any damage, loss, or theft of equipment during your rental period. Charges may apply as outlined in the Waiver.

Supervision
You are responsible for supervising all participants and ensuring safe use of equipment, especially by children.

5. Liability

Waiver of Liability
Your rental and use of equipment are governed by the Game Rental Agreement, Terms of Service & Liability Waiver accepted at checkout.

That agreement includes a full assumption of risk, release of liability, and indemnification provisions.

By renting from MAKA Games, you agree to be bound by those terms, including risks associated with the use, setup, transport, and storage of equipment.

Limitation of Liability
To the maximum extent permitted by law, MAKA Games shall not be liable for any indirect, incidental, or consequential damages, including but not limited to:

  • Event disruption

  • Lost profits

  • Business interruption

If liability is established, it will not exceed the total rental fees paid.

6. Cancellations & Refunds

All cancellations and refund terms are governed by the cancellation policy outlined in the Waiver accepted at checkout.

7. Website Use

You agree not to:

  • Use the website for unlawful purposes

  • Attempt unauthorized access to systems

  • Interfere with website functionality

  • Use content without permission

We reserve the right to suspend or terminate access if these terms are violated.

8. Privacy

Your use of our website is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

9. Termination

We may suspend or terminate your access to our services if you:

  • Violate these Terms

  • Breach the Waiver

  • Engage in unlawful or harmful conduct

Upon termination, all outstanding obligations remain enforceable.

10. Governing Law

These Terms & Conditions are governed by the laws of the Province of British Columbia, Canada.

Any disputes shall be resolved in the courts located in Vancouver, British Columbia.

11. Force Majeure

We are not liable for delays or failure to perform due to events beyond our control, including but not limited to:

  • Severe weather

  • Natural disasters

  • Government actions

  • Transportation or supply disruptions

12. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.

13. Entire Agreement

These Terms & Conditions, together with the Waiver and any booking confirmation, form the entire agreement between you and MAKA Games.
